Welcome to Hedgly (“we,” “our,” or “us”). These Terms and Conditions govern your use of the Hedgly platform, website, and associated audio/text notification services (the “Service”). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2.2 Not Regulated Advice: We are not regulated or authorised by the Financial Conduct Authority (FCA). The Service does not, and is not intended to, provide financial, investment, tax, or legal advice.

2.3 No Recommendations: No alert, daily digest, or monthly deep dive generated by Hedgly — whether in text or audio (TTS) format — constitutes a personal recommendation to buy, sell, or hold any security. Statements provided by our AI regarding market movements (e.g., “Stock fell following earnings reports”) are historical attributions based on cached news, not forward-looking predictions.

2.4 User Responsibility: You are solely responsible for your own investment decisions. You acknowledge that financial markets are volatile, and you should independently verify any data provided by Hedgly before executing trades.

3.1 Service Tiers: Hedgly operates on a tiered subscription model (Free, Regular, and Premium). Your data polling frequency and maximum ticker limits are dictated by your active tier.

3.2 Auto-Renewal & Reminders: Paid subscriptions are billed in advance on a rolling monthly basis. Your subscription will automatically renew unless cancelled. In accordance with the UK Digital Markets, Competition and Consumers Act (DMCCA), we will send you clear reminder notices prior to your renewal dates.

3.3 Cancellation & Cooling-Off: You may cancel your subscription easily at any time via the billing portal in your web dashboard. Furthermore, you have a statutory 14-day cooling-off period from the start of your initial paid subscription (and following certain renewals) to cancel and request a refund. Outside of these cooling-off periods, cancellations take effect at the end of your current billing cycle, and you will retain access to your paid tier until that cycle concludes.

4.1 Third-Party Data: Market data is sourced via third-party API providers. While we strive for accuracy, we do not warrant that the market data or cached news is real-time, completely accurate, or uninterrupted.

4.2 AI Limitations: Hedgly utilises Large Language Models (LLMs) to synthesise information. You acknowledge that AI is subject to limitations and occasional inaccuracies (“hallucinations”). Hedgly is not liable for any losses incurred due to reliance on AI-generated summaries.

4.3 Uptime: We utilise secure cloud hosting and routing infrastructure to maintain high availability. However, we do not guarantee 100% uptime. Real-Time Monitor alerts may be delayed due to external API rate limits, network congestion, or necessary maintenance.

5.1 Personal Use: Your account and private RSS feeds are for your personal use only. You may not share, resell, or publicly broadcast the audio reports or data generated by Hedgly.

5.2 Fair Usage: You agree not to attempt to bypass our automated rate-limiting, artificially inflate data requests, or reverse-engineer the Hedgly platform, its proprietary automation logic, or its backend data pipelines.

5.3 Security: You are responsible for keeping your login credentials and private RSS URLs secure.

6.1 Ownership: All intellectual property rights in the Hedgly platform, including its underlying code, design, branding, and proprietary data processing workflows, belong exclusively to us.

6.2 User Data: You retain ownership of your portfolio configuration data. By using the Service, you grant us a licence to process this data solely for the purpose of operating the Service (e.g., querying master tickers and dispatching notifications).

To the maximum extent permitted by English law, [Your Limited Company Name] shall not be liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, lost savings, or investment losses arising from your use of the Service, delayed notifications, or inaccurate data. Our total aggregate liability to you shall not exceed the total subscription fees paid by you in the six (6) months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
